Terms of Sale and Use

These Terms of Sale and Use ("Terms") are a binding agreement between you and Finders LLC, a Florida limited liability company (document no. L26000327923) doing business as False Vintage (fictitious name registered with the Florida Department of State), 611 NW 92nd Ave, Pembroke Pines, FL 33024 ("False Vintage", "we", "us" or "our"). They govern your use of shopfalsevintage.com and any related pages, emails and services (together, the "Site") and every purchase you make through the Site.

Please read Section 17 carefully. It contains an agreement to resolve disputes through individual arbitration and a waiver of class actions, which affects how disputes between you and us are resolved. You may opt out as described in Section 17.8.

By browsing the Site, creating an account, signing up for emails, or placing an order, you agree to these Terms and to the policies they incorporate: the Privacy Policy, Cookie Notice, Returns and Refunds Policy, Shipping Policy, Authenticity and Condition Policy and, if you subscribe, the Email and SMS Marketing Terms. If you do not agree, do not use the Site.

1. Who may use the Site

You must be at least 18 years old, or the age of majority where you live, to buy from the Site. If you are under that age you may browse only with the involvement of a parent or guardian. You agree that the information you give us is accurate and that you are not barred from receiving goods under the laws of the United States or the country of delivery, including sanctions and export rules.

2. About our goods

2.1 Pre-owned, one-of-a-kind items

Almost everything we sell is pre-owned vintage clothing, footwear and accessories. Each listing is a single physical item. Items are sold in the condition described and shown, with the age-related wear, fading, repairs and imperfections that come with vintage goods. Details on how we grade condition, date items and measure them are in the Authenticity and Condition Policy, which forms part of these Terms.

2.2 Descriptions, photos and measurements

We photograph and measure every item ourselves and describe it as accurately as we can. Colours can look different on different screens, and hand measurements can vary by up to about half an inch (1.3 cm). Sizes on vintage tags often do not match modern sizing, so please compare the listed measurements with a garment you own. A listed size based on measurements is our judgement, not a guarantee of fit.

2.3 Brands and trademarks

Brand names, logos and trademarks that appear on items or in listings belong to their owners. We name brands only to describe genuine items we are reselling. False Vintage is not affiliated with, sponsored by or endorsed by any brand we sell unless we say so expressly.

2.4 Availability across other marketplaces

We also sell through other marketplaces. Because each item is one of a kind, an item can sell elsewhere at the same moment you order it here. If that happens, we will cancel your order for that item, tell you promptly, and refund the full amount you paid for it, including shipping and any taxes and duties charged, to your original payment method.

3. Prices, taxes and errors

• Prices are shown in US dollars unless stated otherwise. Your card issuer may apply its own currency conversion and fees for non-US cards.
• Shipping, applicable sales tax and, for international orders, import duties and taxes are calculated and shown at checkout before you pay. See the Shipping Policy.
• We collect Florida sales tax on orders delivered in Florida, and sales or use tax in any other state where we are required to.
• Prices on the Site may differ from prices for the same item on other marketplaces.
• Promotions. Current promotions are shown in the banner at the top of the Site and apply automatically at checkout; no code is needed. Buy one, get one 10% off: when an order contains two or more items, the items are ranked by price and the lower-priced item in each pair (second, fourth and so on) is discounted by 10%. Free shipping: orders whose item total after discounts is $75 or more qualify for free standard shipping to addresses in the contiguous United States. Promotions cannot be applied to past orders, have no cash value, and may be changed or ended at any time; the promotion shown at checkout when you pay is the one that applies to your order.
• Errors. If an item is listed at an obviously wrong price or with a materially wrong description because of a typographical, photographic or system error, we may cancel any order for that item before it ships, even after you have received an order confirmation. If we do, we will refund you in full. If the item has already shipped, we will honour the price or offer you a full refund on return at our cost.

4. Ordering and contract formation

1. A listing on the Site is an invitation to make an offer, not an offer by us. When you place an order you offer to buy the items in your cart at the stated price.
2. Your order confirmation email confirms we received your order. The contract for an item is formed when we email you that the item has shipped, or when we accept payment, whichever comes first.
3. We may refuse or cancel an order, in whole or in part, for reasons including suspected fraud, an item having sold elsewhere (Section 2.4), errors (Section 3), inability to ship to your address, or a legal restriction. If we cancel after charging you, we refund the full amount charged for the cancelled items.
4. An item in your cart is not reserved for you until checkout is complete. During payment we hold the item briefly so that only one buyer can pay for it at a time.
5. We may limit quantities, including to one per customer for a given drop.

5. Payment

• Payments are processed by Stripe, Inc. We never see or store your full card number. Stripe's own terms and privacy policy apply to the processing of your payment.
• You authorise us to charge your payment method for the total shown at checkout. You confirm you are authorised to use that payment method.
• If a payment is declined or reversed, we may cancel the order or suspend delivery.
• Chargebacks. If you have a problem with an order, please contact us first at getdrippy@shopfalsevintage.com; we answer within two business days and most issues are fixed faster than a bank dispute. Nothing in these Terms limits your right to dispute a charge with your card issuer.

6. Shipping, title and risk of loss

Shipping times, carriers, international duties and lost-parcel handling are covered in the Shipping Policy. Title to an item passes to you when the carrier delivers it. Risk of loss passes to you on delivery to the address you gave us. If a parcel is lost or damaged before delivery, we will resolve it as set out in the Shipping Policy.

7. Returns and refunds

Our 14-day return window, conditions, refund timing and exceptions are in the Returns and Refunds Policy, which forms part of these Terms.

8. Accounts

You can check out as a guest. If we offer accounts, you are responsible for keeping your login details secure and for activity under your account. Tell us immediately at getdrippy@shopfalsevintage.com if you think someone has used your account without permission. We may suspend accounts used in breach of these Terms.

9. The Site's interactive features

The Site includes playful features such as an entry screen, animated hands, crumpling animations and joke confirmation messages (for example, warnings about your aura or drip levels). They are entertainment. Nothing is purchased until you complete checkout and payment, and a joke message never changes the price, terms or what you are buying. You can turn off most motion by enabling "reduce motion" in your device settings.

10. Acceptable use

You agree not to:

• use the Site for anything unlawful, fraudulent or harmful;
• scrape, copy or harvest listings, photos or data by automated means, except for search engines indexing public pages in line with our robots.txt;
• use our photos or descriptions to sell items, including the same item, elsewhere;
• buy items for the purpose of placing fraudulent chargebacks, or make false claims of non-delivery, damage or inauthenticity;
• interfere with the Site's security, performance or features, introduce malicious code, or attempt to access accounts or systems that are not yours;
• impersonate anyone or misrepresent your affiliation with anyone.

11. Intellectual property

The Site and its content, including the False Vintage name, the "False Union Registered" seal, the hand illustrations and animations, the drawn artwork, our photographs and written descriptions, the Site design and code, are owned by or licensed to us and protected by copyright, trademark and other laws. We grant you a limited, revocable, non-transferable licence to view the Site for personal shopping. You may share links to listings. Any other copying, reproduction or reuse needs our written permission.

12. Reviews, messages and other content you send

If you send us reviews, photos, messages or suggestions, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display them in connection with the Site and our business, and you confirm you have the right to grant that licence. We will not edit a review to change its meaning. Nothing in these Terms restricts your right to post an honest review of us anywhere.

13. Third-party services and links

The Site uses third-party services, including Stripe for payments, Shippo and the carriers for shipping, and Cloudflare for hosting. It may link to our marketplace shops and social media. We are not responsible for third-party sites or services, and their terms and privacy policies apply when you use them.

14. Disclaimers

Except as expressly stated in these Terms, the Returns and Refunds Policy and the Authenticity and Condition Policy, and to the fullest extent permitted by law: the Site is provided "as is" and "as available"; and items are sold as described in their listings, with no other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Vintage items are used goods and are not new. We do not promise that the Site will be uninterrupted, error-free or free of harmful components.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing in these Terms excludes or limits any right you have that cannot be excluded or limited by law, including your statutory rights as a consumer in your country.

15. Limitation of liability

To the fullest extent permitted by law, False Vintage will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or relating to the Site or any purchase, even if advised of their possibility. Our total liability for any claim arising out of or relating to these Terms, the Site or any item is limited to the amount you paid us for the item or order that gave rise to the claim.

These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

16. Indemnity

You agree to indemnify and hold False Vintage harmless from claims, losses and reasonable legal fees arising from your breach of these Terms, your misuse of the Site, or your violation of law or of someone else's rights. This section does not apply to claims arising from our own breach or negligence.

17. Disputes: informal resolution, arbitration and class action waiver

17.1 Talk to us first

Before starting any formal proceeding, you agree to email getdrippy@shopfalsevintage.com with your name, order number, a description of the problem and what you want, and to give us 30 days to resolve it. We agree to do the same before starting a proceeding against you.

17.2 Agreement to arbitrate

If we cannot resolve a dispute informally, you and False Vintage agree that any dispute, claim or controversy arising out of or relating to these Terms, the Site or any purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except as stated in Sections 17.4 and 17.5. The Federal Arbitration Act governs this Section.

17.3 Costs and location

Fees are allocated as the AAA Consumer Arbitration Rules require. The arbitration may be conducted by video, by phone or on written submissions, or in person in the county where you live. The arbitrator may award the same individual relief a court could.

17.4 Small claims

Either of us may bring an individual claim in small claims court instead, if it qualifies.

17.5 Intellectual property and injunctions

Either of us may seek an injunction in court to stop infringement or misuse of intellectual property.

17.6 Class action waiver

You and False Vintage agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective or representative proceeding.

17.7 Severability of this Section

If the class action waiver is found unenforceable for a particular claim, that claim must be severed and brought in court, and the rest of this Section continues to apply.

17.8 Your right to opt out

You may opt out of this arbitration agreement by emailing getdrippy@shopfalsevintage.com within 30 days of first accepting these Terms, with the subject line "Arbitration opt-out" and your name and email address. Opting out does not affect any other part of these Terms.

17.9 Buyers outside the United States

If you live in the European Union, the United Kingdom or another country whose law gives consumers the right to bring claims in their local courts, this Section 17 does not take that right away.

18. Governing law and venue

These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. Subject to Section 17, any court proceeding must be brought in the state or federal courts located in Broward County, Florida, and both parties consent to their jurisdiction. This does not deprive consumers outside the US of the protection of mandatory laws of their home country.

19. Changes to these Terms

We may update these Terms. The version in force when you place an order applies to that order. We will post changes on this page with a new "last updated" date, and for material changes we will give notice on the Site or by email at least 14 days before they take effect, except where a change is required by law.

20. General

• Entire agreement. These Terms and the policies they incorporate are the entire agreement between you and us about the Site and your purchases.
• Severability. If any provision is unenforceable, the rest stays in effect.
• No waiver. Not enforcing a provision is not a waiver of it.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor business, or the LLC may change its name, with notice to you.
• Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including carrier disruptions, customs holds, natural disasters, strikes and outages. We will tell you about the delay and you may cancel an unshipped order for a full refund.
• Notices. We may send notices to the email address you give us. You may send notices to getdrippy@shopfalsevintage.com or by mail to 611 NW 92nd Ave, Pembroke Pines, FL 33024.
• Language. These Terms are written in English. Any translation is for convenience only.
